Foreign Investment
While Canada welcomes foreign investment, certain business investments by non-Canadians are subject to special rules and restrictions. Our firm has a long history representing foreign investors seeking to establish a business, acquire a business or expand an existing business in Canada. In this context, we have advised clients in a wide variety of industries on the potential application of Canada's foreign investment laws to their proposed investment. We negotiate on behalf of clients with all levels of government with regard to regulatory issues, tax and financial incentives. We also have extensive experience counselling clients on the tax aspects of their Canadian investments.
Investment Canada Act
We advise non-Canadian investors on the application of the Investment Canada Act to their proposed investment and the need for notification or, potentially, review under this legislation and assist with the completion and filing of notifications or the processing of reviews.
Foreign investments in certain industries or sectors, such as telecommunications, broadcasting, mining, book distribution, medical device distribution, and drug distribution, may also be subject to other federal or provincial legislation. We assist investors in these specialized sectors to understand and address the requirements of applicable legislation so that they may complete their investment in a timely manner.
